Article 2. Applicability

2.1 These General Terms and Conditions of Sale (hereinafter: Terms and Conditions) apply to all offers, orders and agreements from our webshop to the exclusion of any other general terms and conditions.

2.2 The acceptance of an offer or the placing of an order implies that you accept the applicability of these Conditions.

2.3 The provisions of these Conditions may only be deviated from in writing, in which case the other provisions shall remain in full force.

2.4 All rights and claims stipulated in these Terms and Conditions and in any further agreements on behalf of our Webshop shall likewise be stipulated on behalf of intermediaries and other third parties engaged by our webshop.

Article 3. Offers/Agreements

3.1 All offers from our webshop are non-binding and our webshop expressly reserves the right to change prices, in particular when this is necessary due to (legal) regulations.

3.2 An agreement is only established after acceptance of your order by our webshop. our webshop is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, our webshop will inform you within ten (10) working days of receiving the order.

Article 4. Prices and Payments

4.1 The prices stated for the products and services offered are in euros, including VAT and excluding handling and shipping costs, any taxes or other levies, unless stated otherwise or agreed upon in writing.

4.2 Payment must be made without discount or compensation. Delivery of the goods shall take place after payment in full of the invoice amount to the account number stated during the ordering process.

4.3 Payment can be made in (one of) the way(s) as indicated during the ordering process.

4.4 If the prices for the offered products and services increase in the period between the order and its execution, you are entitled to cancel the order.

Article 5. Delivery

5.1 The delivery times given by our webshop are indicative only. Exceeding any delivery period does not entitle you to compensation, nor does it entitle you to cancel your order or dissolve the agreement, unless the delivery period is exceeded to such an extent that you cannot reasonably be expected to leave the agreement intact. In that case, you are entitled to cancel the order or to dissolve the agreement insofar as this is necessary.

5.2 Delivery of the products shall take place at the place and time at which the products are ready for dispatch to you.

Article 6. Retention of title

6.1 Ownership of products delivered shall not be transferred until you have paid all that is owed to our webshop on the basis of any agreement. The risk in respect of the products shall pass to you at the moment of delivery.

Article 7. Complaints and Liability

7.1 Upon delivery, you are obliged to examine whether the products meet the agreement. If this is not the case, you must inform our webshop in writing, stating reasons, as soon as possible and, in any event, within seven (7) working days of delivery, or after observation was reasonably possible.

7.2 If it has been demonstrated that the products do not comply with the agreement, our Webshop has the choice of replacing the products in question with new products upon their return or refunding the invoice value thereof.

7.3 If you do not wish to purchase a product for whatever reason, you have the right to return the product to our webshop within seven (7) working days of delivery. In this case, returns will only be accepted if the product's packaging is undamaged and any plastic seal on the packaging has not been broken, whereby the costs of returning the product will also be borne by you. In addition, when crediting shipping and handling costs will be deducted. If payment is made by Ideal, an additional 1.50 will be deducted.

Article 8. Orders/communications

8.1 Voor misverstaan, verminkingen, vertragingen of niet behoorlijk overkomen van bestellingen en mededelingen ten gevolge van het gebruik van internet of enig ander communicatiemiddel in het verkeer tussen u en onze webshop, dan wel tussen onze webshop en derden, voor zover betrekking hebbend op de relatie tussen u en onze webshop, is onze webshop niet aansprakelijk, tenzij en voor zover sprake mocht zijn van opzet of grove schuld van onze webshop.

Article 9. Force majeure

9.1 Without prejudice to its other rights, our web shop shall, in the event of force majeure, have the right, at its own discretion, to suspend implementation of your order or to dissolve the agreement without judicial intervention by informing you of this in writing and without our web shop being liable to pay any compensation unless, in the given circumstances, this would be unacceptable according to the criteria of reasonableness and fairness.

9.2 Force majeure shall mean any shortcoming which cannot be attributed to our Webshop, because it is not due to its fault, and for which it cannot be held accountable by virtue of the law, legal act or generally accepted practice.

Article 10. Complaints

10.1 Bent u niet tevreden over één van onze producten of onze service? U kunt binnen 7 dagen na het constateren van de gebreken uw klacht mailen naar info@aircoseals.com. We vragen u om uw klacht zo volledig en duidelijk mogelijk te omschrijven, zodat wij u zo goed mogelijk kunnen helpen. Wij antwoorden binnen 7 dagen.

10.2 In case of complaints, you should first contact us. If the complaint cannot be solved by mutual agreement, please contact Stichting WebwinkelKeur (http://www.webwinkelkeur.nl/), who will mediate free of charge. If there is still no solution, you have the possibility to let your complaint be handled by the independent dispute commission appointed by Stichting WebwinkelKeur, the ruling of this is binding and both we and you agree to this binding ruling. To submit a dispute to this dispute committee are costs that you have to pay to the committee. It is also possible to submit complaints via the European ODR platform (http://ec.europa.eu/odr).

10.4 A complaint shall not suspend our obligations, unless we indicate otherwise in writing.

Article 11. Right of withdrawal

11.1 Bij de aankoop van producten heeft u de mogelijkheid de overeenkomst zonder opgave van redenen te ontbinden gedurende 14 dagen. Deze bedenktermijn gaat in op de dag na ontvangst van het product.

11.2 Tijdens de bedenktijd dient u zorgvuldig om te gaan met het product en de verpakking. U dient het product slechts in die mate uit te pakken of te gebruiken voor zover dat nodig is om te kunnen beoordelen of u het product wenst te behouden. Indien u van uw herroepingsrecht gebruik maakt, zal u het product met alle geleverde toebehoren en – indien redelijkerwijze mogelijk – in de originele staat en verpakking aan ons retourneren, conform de door ons verstrekte redelijke en duidelijke instructies.

11.3 Wanneer u gebruik wenst te maken van uw herroepingsrecht bent u dat verplicht dit binnen 14 dagen, na ontvangst van het product, kenbaar te maken aan ons. Het kenbaar maken dient u te doen door een mail te sturen naar info@aircoseals.com. U ontvangt dan binnen 72 uur een retournummer. Nadat u kenbaar heeft gemaakt gebruik te willen gebruik maken van uw herroepingsrecht dient de u het product binnen 14 dagen retour te sturen. U dient te bewijzen dat de geleverde zaken tijdig zijn teruggestuurd, bijvoorbeeld door middel van een bewijs van verzending.

11.4 Indien u na afloop van de in lid 2 en 3 genoemde termijnen niet kenbaar hebt gemaakt gebruik te willen maken van uw herroepingsrecht resp. het product niet aan de ondernemer heeft teruggezonden, is de koop een feit.

11.5 Indien u gebruik maakt van uw herroepingsrecht, komen ten hoogste de kosten van terugzending voor uw rekening, tenzij anders afgesproken met ons.

11.6 Indien u een bedrag betaald heeft, zullen wij dit bedrag zo spoedig mogelijk, doch uiterlijk binnen 14 dagen na herroeping, terugbetalen. Hierbij is wel de voorwaarde dat het product reeds terugontvangen is door ons of sluitend bewijs van complete terugzending overlegd kan worden. Terugbetaling zal geschieden via dezelfde betaalmethode die door u is gebruikt tenzij u nadrukkelijk toestemming geeft voor een andere betaalmethode.

11.7 Bij beschadiging van het product door onzorgvuldige omgang door u zelf, bent u aansprakelijk voor eventuele waardevermindering van het product.

Artikel 12. Diversen

12.1 Indien u aan onze webshop schriftelijk opgave doet van een adres, is onze webshop gerechtigd aan dat adres alle bestellingen te verzenden, tenzij u aan onze webshop schriftelijk opgave doet van een ander adres waaraan uw bestellingen dienen te worden gezonden.

12.2 Wanneer door onze webshop gedurende korte of langere tijd al dan niet stilzwijgend afwijkingen van deze Voorwaarden zijn toegestaan, laat dat onverlet haar recht alsnog directe en strikte naleving van deze Voorwaarden te eisen. U kunt nimmer enig recht doen laten gelden op grond van het feit dat onze webshop deze Voorwaarden soepel toepast.

12.3 Indien één of meer van de bepalingen van deze Voorwaarden of enige andere overeenkomst met onze webshop in strijd mochten zijn met enig toepasselijk rechtsvoorschrift, zal de betreffende bepaling komen te vervallen en zal deze worden vervangen door een door onze webshop vast te stellen nieuwe rechtens toelaatbare vergelijkbare bepaling.

12.4 onze webshop is bevoegd om bij de uitvoering van uw bestelling(en) gebruik te maken van derden.

Artikel 13. Toepasselijk recht en bevoegde rechter

13.1 Op alle rechten, verplichtingen, aanbiedingen, bestellingen en overeenkomsten waarop deze Voorwaarden van toepassing zijn, alsmede op deze Voorwaarden, is uitsluitend Nederlands recht van toepassing.

13.2 Alle geschillen tussen partijen zullen bij uitsluiting worden voorgelegd aan de daartoe bevoegde rechter in Nederland.

Artikel 14. Garantie

14.1 Onze webshop biedt een garantie van 12 maanden op de door ons verkochte producten, mits het product niet beschadigd is. Deze garantie houdt in dat de producten vrij moeten zijn van materiaal- en fabricagefouten gedurende de gehele garantieperiode.

14.2 De garantie dekt geen schade als gevolg van onjuist gebruik, misbruik, nalatigheid, ongelukken, wijzigingen aan het product, of enige andere vorm van schade die niet het gevolg is van een materiaal- of fabricagefout.

14.3 Als u van mening bent dat uw product onder de garantie valt, dient u contact op te nemen met onze webshop via het e-mailadres info@aircoseals.com om het probleem te melden en instructies te ontvangen over het retourneren van het product.

14.4 Onze webshop behoudt zich het recht voor om het product te repareren of te vervangen, naar eigen goeddunken, als wordt vastgesteld dat er een geldige garantieclaim is.

14.5 Eventuele kosten voor retourzendingen van producten in het kader van garantieclaims zijn voor rekening van de koper, tenzij anders schriftelijk overeengekomen met onze webshop.

14.6 Deze garantie is aanvullend op uw wettelijke rechten als consument en heeft geen invloed op die rechten.
